1. Acceptance of Terms

Welcome to LobsAI Coder. By accessing or using our VS Code extension, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and LaabamOne Business Solutions Pvt Ltd ("LobsAI," "we," "us," or "our"). We reserve the right to modify these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

2. Description of Service

LobsAI Coder is an AI-powered coding assistant that integrates with Visual Studio Code to provide:

• Intelligent code completion and suggestions
• Real-time code optimization and refactoring
• Automated documentation generation
• Multi-language programming support
• Integration with multiple AI providers (OpenAI, Anthropic, Google Gemini, AWS Bedrock, etc.)
• Model Context Protocol (MCP) for extensibility

3. User Accounts and Registration

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

3.2 Account Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you meet this age requirement.

4. Subscription Plans and Payments

4.1 Free and Paid Plans

We offer both free and paid subscription plans. Paid plans may include additional features, increased usage limits, and priority support.

4.2 Billing and Payment

• Subscription fees are billed in advance on a recurring basis (monthly or annually)
• All fees are non-refundable except as required by law or as explicitly stated
• You authorize us to charge your payment method for all fees incurred

4.3 Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. We do not provide refunds for partial subscription periods.

You retain ownership of any code, content, or data you input into the Service. By using the Service, you grant us a limited license to process, store, and analyze your content solely to provide the Service to you.

6.3 AI-Generated Content

Content generated by our AI models is provided "as is." You are responsible for reviewing and validating all AI-generated content before use. We do not claim ownership of AI-generated content, but you acknowledge that similar content may be generated for other users.

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

8. Third-Party Services and AI Providers

Our Service integrates with third-party AI providers (such as OpenAI, Anthropic, Google, and AWS). Your use of these integrations is subject to the respective third-party terms and privacy policies. We are not responsible for the practices or content of third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Guarantees that the Service will be uninterrupted, timely, secure, or error-free
• Warranties regarding the accuracy, reliability, or completeness of AI-generated content
• Guarantees that defects will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOBSAI AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to or use of our servers
• Damages resulting from bugs, viruses, or other harmful code
• Damages resulting from errors in AI-generated content

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless LobsAI, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit or generate through the Service

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and data
• Provisions that by their nature should survive termination will survive

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

13.2 Arbitration

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996.

14. Miscellaneous

14.1 Entire Agreement

These Terms constitute the entire agreement between you and LobsAI regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary.

14.3 Waiver

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
